OVERVIEW

Welcome to Drippr! The terms "we", "us" and "our" refer to Meet in the Mountains UG, the operator of the Drippr online store. Drippr is a brand of Meet in the Mountains UG, a company registered under German law.

These Terms of Service ("Terms") govern your use of our online store and the purchase of our products. By placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.

These Terms apply to consumers (private individuals purchasing for non-commercial purposes) and comply with applicable EU and German consumer protection law, including the Bürgerliches Gesetzbuch (BGB), the Fernabsatzrecht (distance selling regulations), and EU Directive 2011/83/EU on consumer rights.

SECTION 2 — SCOPE AND ACCESS

By using our store, you confirm that you are at least 18 years of age, or have the consent of a parent or legal guardian. You are responsible for ensuring that all information you provide — including your name, address, and payment details — is accurate and complete.

We currently sell and ship to Germany, the Netherlands, and Austria. We reserve the right to refuse orders from other regions at our discretion.

SECTION 3 — OUR PRODUCT

Drippr sells physical goods — specifically a drying rack designed for soft flasks, suitable for outdoor and trail running use. We take care to describe our products accurately, but please note that colors and product appearance may vary depending on your screen settings and device.

Product descriptions and specifications are subject to change at any time. We reserve the right to discontinue or limit availability of any product at our sole discretion. Product images are for illustrative purposes only.

SECTION 4 — CONCLUSION OF CONTRACT (ORDERS)

When you place an order in our online store, you are making a binding offer to purchase the selected products. A contract between you and Meet in the Mountains UG is only formed once we send you an explicit order confirmation by email.

Our order confirmation email constitutes acceptance of your offer. We reserve the right to decline any order at our discretion, for example if a product is out of stock or if payment cannot be processed. In such cases, you will be notified promptly and any payment received will be refunded in full.

Please review your order carefully before submitting. Once an order is confirmed, changes or cancellations may not be possible outside of your statutory right of withdrawal (see Section 7).

SECTION 5 — PRICES AND PAYMENT

All prices shown in our store are inclusive of statutory VAT (where applicable) and exclusive of shipping costs. Shipping costs are displayed separately at checkout before you complete your order.

Prices are subject to change without notice. The price applicable to your order is the price displayed at the time of order placement, as confirmed in your order confirmation email.

We accept payment via the methods listed at checkout. Payment must be received and successfully processed before we dispatch your order. You warrant that you are authorized to use the payment method provided.

SECTION 6 — SHIPPING AND DELIVERY

We ship to Germany, the Netherlands, and Austria. Delivery times stated on our website are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs processing, or circumstances beyond our control.

Risk of loss and damage passes to you once we hand the goods over to the carrier. Title to the goods transfers to you upon full receipt of payment.

If a delivery fails due to incorrect address information provided by you, any costs for re-shipping are at your expense.

SECTION 7 — RIGHT OF WITHDRAWAL (WIDERRUFSRECHT)

Withdrawal Notice

As a consumer purchasing from us as a distance seller, you have the right to withdraw from this contract within 14 days without giving any reason, in accordance with German law (§§ 312g, 355 BGB) and EU Directive 2011/83/EU.

The withdrawal period is 14 days from the day on which you, or a third party designated by you (other than the carrier), take physical possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision by means of a clear statement (e.g. by email) before the withdrawal period expires:

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of supplementary costs arising if you

chose a type of delivery other than the least expensive standard delivery we offer), without undue delay and in any event no later than 14 days from the day on which we are informed of your decision.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the goods back, or until you have provided evidence of having sent back the goods, whichever is the earliest.

You must return the goods to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

SECTION 8 — STATUTORY WARRANTY (GESETZLICHE GEWÄHRLEISTUNG)

Your statutory warranty rights under German law apply in full. Under §§ 434 et seq. BGB, goods must be free from material defects and conform to the contract. If a defect exists at the time of delivery, you are entitled to:

(a) supplementary performance (repair or replacement),

(b) reduction of the purchase price, or (c) withdrawal from the contract,

subject to the conditions of applicable law. The statutory limitation period for claims based on defects is two (2) years from delivery.

These warranty rights are in addition to, and do not affect, any voluntary manufacturer's guarantee that may apply.

SECTION 9 — INTELLECTUAL PROPERTY

All content on this website, including text, images, graphics, logos, and product descriptions, is owned by or licensed to Meet in the Mountains UG and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this site for commercial purposes without our prior written consent.

SECTION 10 — PRIVACY

We process your personal data in accordance with our Privacy Policy and applicable data protection law, including the General Data Protection Regulation (GDPR) and the German Bundesdatenschutzgesetz (BDSG). Our Privacy Policy is available at https://www.drippr.shop/policies/privacy-policy. By using our store, you acknowledge that you have read and understood our Privacy Policy.

Our store is powered by Shopify. Shopify processes certain data as part of providing its platform services. For details, please refer to Shopify's privacy policy.

SECTION 11 — LIMITATION OF LIABILITY

We are liable without limitation for damages arising from injury to life, body, or health caused by us, and for damages caused by intentional or grossly negligent conduct by us or our legal representatives or agents.

For simple negligence, we are only liable if an essential contractual obligation (Kardinalpflicht) has been breached. In such cases, liability is limited to foreseeable, contract-typical damages.

Any further liability is excluded to the extent permitted by law. This limitation does not affect your statutory rights as a consumer, including rights under the Product Liability Act (Produkthaftungsgesetz).

SECTION 12 — PROHIBITED USES

You may use our store for lawful purposes only. You may not use our services: (a) in any way that violates applicable law or regulation; (b) to transmit unsolicited commercial communications; (c) to attempt to gain unauthorized access to our systems; (d) to scrape, copy, or extract data from our store by automated means; or (e) for any purpose that could harm us, our users, or third parties.

SECTION 13 — GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer resident in another EU member state, you also retain the protection of the mandatory provisions of the law of your country of residence.

In the event of disputes, we will endeavor to find an amicable resolution. If a dispute cannot be resolved amicably, the courts of Germany have jurisdiction, subject to any mandatory rules applicable to consumers under EU law.

The European Commission provides an online dispute resolution (ODR) platform, available at: https://ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration board, but are willing to do so in individual cases.

SECTION 14 — CHANGES TO THESE TERMS

We reserve the right to update these Terms at any time. The current version will always be available on this page. We will notify you of material changes in advance where required by law. Your continued use of our store after changes take effect constitutes acceptance of the updated Terms.

SECTION 15 — SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity of the remaining provisions.
